Terms of Use and End User License Agreement (EULA)

This Terms of Use and End User License Agreement ("Agreement") governs your use of the NCLEX AI mobile application developed by Monisoft.

1. License Grant

Subject to your compliance with this Agreement, Monisoft grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the app for personal, non-commercial purposes.

Under this license, you may not:

• Copy, modify, distribute, or create derivative works of the app
• Reverse engineer, decompile, or disassemble the app
• Remove or alter any proprietary notices in the app
• Use the app for any unlawful or unauthorized purpose

2. Description of Service

NCLEX AI is a mobile application designed to help nursing students prepare for the NCLEX-RN and NCLEX-PN licensure examinations. The app provides:

• AI-powered personalized coaching and study plans
• Topic-based question banks and practice tests
• Performance statistics and progress tracking
• Mistake analysis and detailed answer explanations
• Live Arena mode with competitive rankings
• Premium subscription with advanced features

3. Account Creation and Security

• You must sign in with a Google or Apple account to use the app.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to your account.
• You may not transfer or share your account with third parties.
• Each user may only have one account; creating multiple accounts is prohibited.

4. Acceptable Use

When using the app, you agree to:

• Use the app only for lawful purposes and in accordance with this Agreement
• Avoid behavior that negatively affects other users' experience
• Not use cheats, bots, automation, or manipulation in Arena mode
• Not copy, screenshot, or commercially distribute app content
• Not attempt to harm the app's infrastructure, servers, or networks
• Not send spam or malicious content

5. Intellectual Property

All content in the app — including but not limited to design, graphics, text, questions, explanations, mascot images, software code, and algorithms — is owned by Monisoft and protected by applicable US and international copyright laws.

User-generated data (performance data, statistics, etc.) remains owned by the user; however, Monisoft retains the right to use such data in anonymized form for service improvement.

6. Subscriptions and Payments

6.1. Subscription Plans

• The app offers a free (ad-supported) tier and a paid Premium tier.
• The free tier includes basic features with ads.
• Premium provides an ad-free experience, unlimited AI coaching, and full content access.
• Current pricing is displayed within the app.

6.2. Payment and Renewal

• Payment is charged to your Apple ID or Google Play account upon purchase confirmation.
• The subscription auto-renews at the same price unless cancelled at least 24 hours before the end of the current period.
• The renewal charge is applied within 24 hours before the end of the current period.

6.3. Free Trial

• If offered, a free trial may only be used once.
• Any unused portion of the free trial is forfeited upon purchasing a paid subscription.

6.4. Cancellation and Refunds

• iOS: Cancel via Settings > [Your Name] > Subscriptions.
• Android: Cancel via Google Play Store > Account > Subscriptions.
• Deleting the app does not cancel your subscription; you must cancel through the store.
• Refund policy is subject to the standard refund rules of the applicable app store (Apple App Store or Google Play Store).

7. AI Content and Disclaimer

NCLEX AI provides AI-powered coaching and recommendations. Please note:

• AI-generated study plans, tips, and explanations are for informational purposes only.
• AI content does not replace professional nursing education, instructors, or official NCSBN materials.
• AI-generated content may occasionally contain errors or inconsistencies; Monisoft does not guarantee its accuracy.
• The AI coaching feature requires server access and may be temporarily unavailable.

8. Limitation of Liability

• The app is provided "as is" and "as available" without any express or implied warranties.
• Passing the NCLEX is not guaranteed. The app is a study aid; results depend on the user's own effort and preparation.
• Monisoft is not liable for any direct or indirect damages arising from errors, omissions, or outdated content in the app.
• Monisoft is not liable for service interruptions, server outages, or technical issues.
• Monisoft's total liability under this Agreement is limited to the total amount you paid for the app in the preceding 12 months.

9. Account Suspension and Termination

• Violation of any provision of this Agreement may result in your account being temporarily or permanently suspended without prior notice.
• Cheating or manipulation detected in Arena mode may result in permanent account closure.
• You may delete your account at any time via Profile > Settings > Delete Account, or by emailing [email protected].
• Account deletion is irreversible; all data will be permanently destroyed within 30 days.

10. Third-Party Services

The app uses third-party services (Google Firebase, Google AdMob, Adapty, OpenAI) to provide its functionality. These services have their own terms of use and privacy policies. By using the app, you also agree to the terms of these third-party services.

11. Changes to This Agreement

Monisoft reserves the right to modify this Agreement at any time. Material changes will be communicated via in-app notification. Changes take effect on the date of publication. Continued use of the app after changes constitutes acceptance of the updated terms.

12. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. Apple-Specific Terms (iOS Users Only)

For the app downloaded via the Apple App Store, the following additional terms apply:

• This Agreement is between you and Monisoft only; Apple Inc. is not a party to this Agreement.
• Apple has no obligation to provide maintenance or support for the app.
• In the event the app fails to conform to applicable warranties, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for any third-party claims relating to the app (including intellectual property infringement claims).
• Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement and have the right to enforce its terms.
